Overpayments of unemployment tax will result in a credit balance on the tax account. 

  • Credits may remain on an account for three years from the original payment postmark date. 
  • After three years, the credit balance will expire per the statute of limitations. 
  • Expired credit balances are not available for refund or for use on future taxes. 

To help prevent overpayments, make sure that you are paying at your assigned tax rate.  Visit How to Find your Tax Rate to verify your tax rate.

You are encouraged to apply a credit balance to future taxes. However, you may choose to request a refund.

Before requesting a refund:

  • Review your account to make sure your address is correct. Visit Updating Your Tax Account Status, Address, and Phone Number for more information.
  • Check your account for past due reports or estimated reports due to non-filing. Estimated reports within the 3-year statute of limitations need to be adjusted for actual wages. Delinquent reports and estimated reports will prevent a credit refund.

You may request a refund in one of two ways: 

  1. Mail in a signed Tax Statement (Form C-69QCR) found under the eCorres tab on the Unemployment Tax Services system or received in the mail. Mail the completed statement to TWC- Refund Request, PO Box 149037, Austin, TX 78714-9037.
  2. Submit a refund request through the contact request form:
    • Reason for contact: Employer Tax Account Actions/Issues
    • Issue that you are having: Request Refund 
    • Comment: Specify an amount to be refunded or type “all available credit”. 

Additional Refund Information: 

  • If you need your refund mailed to a different address other than the mailing address on record for the employer account, the refund request must come from either an owner/officer, or an authorized person/company with a C-42 written authorization on file.  
  • Refund requests can take up to 180 days to process. 
  • All payments must have exceeded 30 days before they can be refunded.
  • All credit card payments must have exceeded 180 days before they can be refunded. This is disclosed when scheduling a credit card payment online.  
  • All available credits expire 3 years from the payment postmark date.  Canceled credits are not available for refund unless a refund request is received within the 3-year statute of limitations period.  
  • Refunds are issued as paper refund warrants, which are official Texas Comptroller of Public Accounts checks.  
  • Refunds can only be issued in the paying entity’s name and cannot be altered.

By law, refund checks are made payable to the legal paying entity. TWC can only add in care of (“%”) and an officer’s name to the styling of the check. Be advised that this does not guarantee your financial institution will take this as an acceptable format to cash your refund check.  You will need to resolve the matter with your financial institution if the restyled refund check is rejected for cash or deposit.

To have a restyled refund check issued to you, please submit a contact request form:

  • Reason for contact: Employer Tax Account Actions/Issues
  • Issue that you are having: Request Refund
  • Comment section: Restyled check needed. Please add in care of (officer's name). 

The original refund check will be voided.  Please allow approximately three weeks to receive the restyled refund check via USPS mail.  However, receipt may be delayed due to USPS mail processing timeframe.

To have a replacement refund check issued to you, please submit a contact request form:

  • Reason for contact: Employer Tax Account Actions/Issues
  • Issue that you are having: Request Refund
  • Comment section: Lost refund check, replacement needed. Include the address where you wish the replacement refund check to be mailed.

The original refund check will be voided.  Please allow approximately three weeks to receive the restyled refund check via USPS mail.  However, receipt may be delayed due to USPS mail processing timeframe.
